Terms & Conditions (Terms of Service)

These Terms & Conditions (“Terms”) govern your access to and use of the ChargeEase platform, website (www.chargeease.org), and services for recurring invoicing and payments (“Services”). By accessing or using the Services, you (“You”, “User”, or “Merchant”) agree to be bound by these Terms. If you are using the Services on behalf of a business, you represent that you have authority to bind that business.

1. Definitions

Account: Your registered account on the Platform.
Customer Data: Data provided by your end-customers (e.g., payment information, invoices).
Personal Data: Any information relating to an identifiable individual.
Subscription: Your paid plan for accessing the Services.
Subscription Fees: Fees for your chosen plan.

2. Services

ChargeEase provides tools for creating recurring invoices, managing subscriptions, and processing payments. We act as a facilitator and do not directly process payments unless integrated with third-party gateways (e.g., compliant with SBP regulations). You are responsible for integrating compliant payment providers.

We grant you a limited, non-exclusive, non-transferable license to use the Services for your internal business purposes during your Subscription term.

3. Your Responsibilities

Provide accurate information and keep your Account secure.
Comply with all applicable laws, including Pakistani laws (e.g., tax, consumer protection, electronic transactions) and international regulations if serving global customers.
Ensure your use of Customer Data (including payment details) complies with privacy laws and obtains necessary consents.
Do not use the Services for illegal activities, reselling without permission, reverse engineering, or transmitting malware.
You are solely responsible for your end-customers’ transactions, disputes, refunds, and compliance (e.g., PCI-DSS if handling card data directly).

4. Billing and Payments

Fees are as per your selected plan on chargeease.org.
Subscriptions auto-renew unless canceled.
Fees are non-refundable except as stated.
Late payments may incur interest (1.5% per month) and lead to suspension.
You authorize us to charge your provided payment method.
Taxes: You are responsible for all applicable taxes.

5. Intellectual Property

The Services, platform, and documentation are owned by ChargeEase. You grant us a license to process your data as needed to provide the Services.

6. Data and Security

We handle Customer Data securely and in compliance with industry standards (e.g., encryption, PCI compliance where applicable).

7. Term, Termination, and Suspension

Term: Monthly or annual, auto-renewing.
Termination: Either party may terminate with notice; we may terminate for breach, non-payment, or violation.
Upon termination: Access ends; retain data for 30-90 days for export.

8. Confidentiality

Both parties agree to protect confidential information.

9. Cookies

We use cookies for functionality and analytics. Manage preferences via browser settings.

9. Disclaimers and Limitation of Liability

Services provided “AS IS” without warranties.
We are not liable for indirect damages; liability capped at fees paid in prior 12 months.

10. Governing Law and Dispute Resolution

Governed by laws of Pakistan. Disputes resolved in courts of [e.g., Karachi/Lahore] or via arbitration.

11. Changes

We may update these Terms; continued use constitutes acceptance.
